Terms of Service

1. What the Service is

The Points Chaser shows award flight availability, meaning flights that can be booked with airline miles or credit card points, gathered automatically from public airline and loyalty program sources. We also provide general information such as transfer partner guides. We don't sell tickets, take bookings, or handle payments. When you book, you do so directly with the airline or loyalty program, under their terms.

We are not affiliated with, endorsed by, or sponsored by any airline, loyalty program, credit card issuer or bank. Their names and logos are trademarks of their respective owners and are used only to identify their programs.

2. Availability and prices are not guaranteed

Award space changes constantly. Our data is refreshed periodically, so a flight shown on the Service may already be gone, priced differently, or carry different taxes, fees, cabin or routing than shown. Transfer ratios and partner information can also change without notice. Always confirm the details on the airline or program website before transferring points or booking. Points transfers are usually irreversible, and we are not responsible for points transferred, or bookings made, based on information from the Service.

3. Accounts

• You must be at least 18 years old, or the age of majority where you live, to create an account.
• Give us an email address you control and keep it up to date. You're responsible for keeping your password secure and for activity under your account.
• One account per person. Don't share your account or let others use it.
• New accounts are reviewed before getting access to member features. We may approve, decline, limit or revoke access at our discretion.

You can ask us to delete your account at any time by emailing nampoints@gmail.com. We may suspend or close accounts that violate these terms or put the Service or other users at risk.

4. Acceptable use

You agree not to:

• scrape, crawl or bulk-download the website or the API, beyond the reasonable use described below;
• bypass account approval, access controls or rate limits, or access another user's account;
• overload, disrupt, probe or attack the Service or its infrastructure;
• resell, republish or commercially redistribute the Service or its member-only data without our written permission;
• use the Service for anything unlawful, or in a way that violates an airline's or loyalty program's terms.

5. Member API

We offer a read-only JSON API at /api to signed-in members whose accounts have been approved. Requests are authenticated by your logged-in session and count as activity on your account. You may use the API for your own personal, non-commercial use, provided that:

• you keep request volumes reasonable;
• you don't share your login or session with anyone else, or build a service that gives other people access to the API through your account;
• you don't publish, resell or redistribute data from the API.

We may change, rate-limit or withdraw the API, or suspend API access for accounts that misuse it, at any time.

6. Our content

The Service's design, software, text and compiled data are owned by us or our licensors. We grant you a personal, non-transferable, revocable license to use the Service as these terms allow. Nothing in these terms gives you any other rights in it.

7. Third-party sites

The Service links to airline, loyalty program and social media websites we don't control. Your use of those sites, and any booking or transaction you make there, is between you and that third party.

8. Changes to the Service

The Service is currently free. We may add, change or remove features, change which features require an account, or stop offering the Service, at any time and without liability to you. If we ever introduce paid features, we'll present their terms before you're charged.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability and non-infringement. We don't warrant that the Service will be uninterrupted, error-free or secure, or that any flight, price or transfer information is accurate, complete or current.

10. Limitation of liability

To the fullest extent permitted by law, The Points Chaser and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of points, miles, bookings, profits, data or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service is limited to US $50.

Some jurisdictions don't allow certain of these limitations, so they apply to you only to the extent the law allows.

11. Indemnity

You agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable legal fees, arising from your misuse of the Service or your violation of these terms.

12. Governing law

These terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-law rules. Any dispute relating to these terms or the Service will be resolved exclusively in the state and federal courts located in Utah, and you consent to their jurisdiction.

13. Changes to these terms

We may update these terms from time to time. We'll change the "Last updated" date above, and for significant changes we'll let signed-up users know by email or a notice on the site. If you keep using the Service after a change takes effect, you accept the updated terms.

14. General

If any part of these terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours as part of a transfer of the Service. These terms and the Privacy Policy are the entire agreement between you and us about the Service.
